One Isah Ibrahim and Faruq Umaru, alleged to have stolen a Yamaha generator and other valuables worth ₦442,000, were on Friday brought before a Chief Magistrates’ Court in Ado-Ekiti.

The defendants, whose ages were given as 65 and 27 respectively and of no fixed addresses, are facing a two-count charge of house breaking and stealing.

The Prosecutor, Insp Oriyomi Akinwale, told the court that the defendants committed the offences sometime in April at about 2:00a.m., at Atikankan Area in Ado-Ekiti.

Akinwale said that the first defendants broke into the house of one Mrs Victoria Ayodele and stole a Yamaha generator valued at N400,000, set of plate valued at ₦30,000 and a blue and black lace cloth valued at ₦12,000.

According to him, the total value of the stolen items was ₦442, 000.

The prosecutor said that when the police investigated the alleged crime, some of the stolen items were traced to the 2nd defendant at Atikankan Area in Ado-Ekiti.

He said the second defendant received blue and black lace clothes from the first defendant, knowing the same to have been stolen or fraudulently obtained.

Akinwale said that the offences committed contravened Sections 411(1) (2) , 390(9) and 427 of the Criminal Code, Laws of Ekiti State, 2012.

The prosecutor urged the court to remand the first defendant in the Correctional Centre pending legal advice from the office of Director of Public Prosecutions (DPP).

He also prayed the court to adjourn the case of the second defendant to enable him to study the case file and assemble his witnesses.

The plea of the first defendant was not taken, while the second defendant pleaded not guilty.

Counsel to the defendants, Mr Gboyega Abiola, urged the court to grant his clients bail, with a promise that they would not jump bail.

However, the prosecutor opposed the bail application of the first defendant, contending that the court lacked jurisdiction to hear the case.

The Chief Magistrate, Mr Bankole Oluwasanmi, ordered the remand of the first defendant at the Correctional Centre, pending the outcome of legal advice from the office of the DPP.

Oluwasanmi granted bail to the second defendant in the sum of N50,000 with two sureties in like sum, saying the sureties must be leaders from the Hausa Community.

He adjourned the case till July 13 for mention.
